Mahmud Mukhtar has substantial experience in advising international oil companies in the
upstream and downstream sectors, oil services companies, international banks and finance
institutions and foreign investors.
Mahmud's practice focuses on advising on various aspects of the Libyan Petroleum Law
and Exploration and Production Sharing Agreements (EPSA), the Libyan Foreign Capital
Investment Laws, as well as acting as counsel in litigation and arbitration before all Libyan
courts and international arbitral venues.
Advised US oil companies in the negotiation of terms of re-entry and restructuring of
exploration concessions frozen during the 1980's.
Advised major international oil exploration and production companies on the negotiation
of EPSA's with the Libyan National Oil Corporation during the various bid rounds held
since 2004, including advising on and the preparation of Arabic documents of new EPSA's
replacing the traditional concessions.
Advised major international cement manufacturer on the bid to acquire an equity interest
in a Libyans state-owned cement concern in conducting the legeal due diligence and
negotiation with Libyan authorities.
Advised the leading five Libyan commercial banks on a LYD25million loan facility to the
Public Telephone and Telecommunications Company.
Advised ABC International Bank plc and Standard Bank on US$16million project finance
of the Intercontinental managed Al Waddan Hotel, Tripoli.
Advised major European bank on US$125million proposed financing of the
Intercontinental Al Ghazala Hotel Development, Tripoli.
Advised international hotel operator on the operation and management of new hotel
development in Tripoli.
Participated in several international arbitrations involving international oil companies in
several jurisdictions including the US, Europe and the Caribbean. These arbitrations
include proceedings between Libyan government and/or the National Oil Corporation of
Libya and the New England Petrolem Corporation in New Yok and the Bahamas (1977),
Libyan American Oil Company in the USA, France, Sweden and Switzerland (1979-1981), Sun Oil
Company (1985) and others.
Represented major international oil companies operating in Libya in tax appeals
relating to the levying of stamp duty on Exploration and Production Sharing Agreements
(EPSA's) and other agreements.
Advised foreign investors on structuring and organizing investments under Libyan
investment laws.
Represented international companies in several actions for trademark infringement in
Libya.
Member of the Libyan Bar Association
Rights of audience before First Instance Courts, Courts of Appeal and the Supreme Court
of Libya.
